North Dakota man with bald tires on vehicle charged with negligent homicide in crash
MANDAN, N.D. -- A 40-year-old Center man has been charged with negligent homicide related to a fatal vehicle crash near Mandan last August that resulted in the death of a 19-year-old.
Jesse Marcus Berger’s initial appearance is scheduled for 1:30 p.m. Friday, July 27, at the Morton County Courthouse.
Around 6 a.m. Aug. 15, a North Dakota Highway Patrol trooper responded to crash on Highway 25, about 6 miles north of Mandan, involving a two-vehicle head-on collision.
According to an affidavit filed in the case, Berger was driving a pickup southbound on Highway 25. The pickup's tires were worn to the point that there was minimal or no tread left.
Berger reportedly took a slight right hand curve and crossed the center line of the road, traveling into the opposite northbound lane. Highway Patrol said he struck a northbound vehicle being driven by Bray Harrison, of Bismarck. Harrison died on scene.
A combination of factors, including rain and darkness outside, the condition of the pickup and Berger's vehicle entering the opposite lane resulted in Harrison's death, the affidavit alleges.
